CheckMeIn Privacy Notice
1. Introduction
Welcome to CheckMeIn, an application that allows you to check-in to events and helps you verify your participation to different happenings based on your location, allowing you to connect and communicate with other participants via the ad-hoc social media network of the event.
To create your profile and use the application a certain amount of personal data is collected. Some of it is automatically collected, and the rest is collected directly by you. The collection and processing of your personal data by the application is always in line with our legal obligations, in compliance with the GDPR 2016/679, and the applicable law on privacy and data protection.
In this Notice you will find a detailed presentation of the reasons and the purposes for which we collect and process personal data, the ways we process it, as well as for how long we retain your data and how we protect it. You will also be informed about who has access to your data, what rights you have on your data and how you may exercise them. We encourage you to read our Privacy Notice thoroughly, as it reflects the Privacy and Data Protection Policy we follow. 2. Who we are
2.1.
This Privacy Notice governs the personal data collected and processed when using the CheckMeIn application.
2.2.
The application is developed, owned, and administered by HYBRIDVERSE ANALYTICS P.C. 2.3.
According to law and the General Data Protection Regulation, HYBRIDVERSE ANALYTICS P.C. is the Data Controller. You may contact us calling using any or all of the aforementioned communication details. 3. Personal data we collect
3.1.
In order to set-up an account and have a complete profile so that you may fully use the CheckMeIn application, you are asked to provide the following personal data:
- Your e-mail address
- Your name and surname
- Your date of birth
- A profile picture
3.2.
Apart from these, other data are automatically collected and processed when using the application. These data include:
- Your check-ins to events
- Your location only when you check in to an event, and only if you allow the application to have access to your current position at the moment of the check-in. If your position is not available when using the app, there is no geolocation data being processed by us. These data are communicated to the organizer of the event you are checking in.
- Data concerning your device and about your internet connection.
- Data that may be generated from all or any other interactions with the application and its features (such as messages, posts and comments in an event or community, whether you like or comment a photo, etc.). All these interaction data are only visible to the Organizer of the Event in which they happen.
4. How we use your data
4.1.
We collect and process your data for the following reasons:
- To set-up and verify your account when using the application
- To allow you find, check-in, and participate to the nearby events or the communities you may be interested to participate.
- To facilitate communication with other participants of an event or a community via the relevant application features, by e-mail or any other contact data of yours that may become available to us.
- To develop, maintain and improve our services, the functionalities of the application and your user experience; for statistical and research purposes; for troubleshooting, testing, and evaluation purposes; for the prevention of fraud and the protection of the integrity of the application and the data it handles; to secure your account.
- To comply with legal and regulatory requirements, as well as, court orders, official orders and judicial decisions.
4.2.
The legal basis for processing your personal data are:
- The execution of a contract, or the taking of steps prior to entering into a contract, and the performance of a contract between you and us after you have accepted the Terms of Use of the application. We cannot offer you our services and you cannot use the application without providing us your data;
- Our legitimate interests, such as the development, maintenance, and protection of our activities and of the application, the personalization of the services we provide, troubleshooting and testing, the prevention of fraud, and handling of legal claims;
- The compliance with the law, relevant regulations and judicial or official orders;
- Your consent, where additional personal data are explicitly and voluntarily provided by you, such as a profile picture or other.
5. How long we keep your data
5.1.
We retain your personal data for as long as it is necessary for the purposes for which they are processed, as mentioned above in Section 3 of this Notice. In more detail:
5.2.
We retain all your account data as long as your CheckMeIn account is open and you use the application.
5.3.
If you disable and/or delete your account from the CheckMeIn application, we retain your account data for three (3) months from the date you disabled/deleted your account, to give you the opportunity to reactivate and restore your account.
5.4.
After this period, unless another time-period is dictated by law, your account data are deleted along with all your check-ins, the interactions you may have with others or with an event, etc. Only aggregate statistical data, that cannot lead back to your identity or allow to trace you, may be kept for analytical purposes.
5.5.
Depending on the case, other retention periods may apply and we may be required to keep your data for a longer period (especially for reasons of legal compliance and for the potential handling of disputes and claims), or shorter period, after which your data are erased from our systems and servers, or anonymized in such a way that cannot lead back to your identity, not even by us.
6. With whom we may share your data
6.1.
The Event organizer of any event that you have checked in, can have access to your personal data, such as your name and surname, age, the time and date of the check-in, and your location (if you allowed us to have access to it), as well as to all interactions you have with the event itself and other participants (such as messaging in the event, likes, comments, photos etc.). The same applies if you participate to a community.
6.2.
CheckMeIn is developed using Supabase (www.supabase.com). The personal data you provide, along with the automatically collected data, when using the application are stored in the servers of Supabase according to their privacy policy. These data are being processed by the application in a secure environment and are protected by all necessary measures in order to prevent any unauthorized access.
6.3.
Apart from the above, your personal data are shared only with service providers that offer services related to the technical operation, maintenance and security of the application. In order to comply with our legal and regulatory obligations, judicial and official orders, and prevent fraud and illegal actions, we may be required to disclose personal data to public authorities, regulatory authorities and other competent parties.
6.4.
Finally, should there be a need of restructuring, merger, acquisition or corporate transaction, we may share your personal data with the parties involved. In case there is a corporate transaction and the application is transferred to another party, the rights and obligations described in this Privacy Notice will also be transferred without any changes.
6.5.
Personal data are never shared with marketing and promotion purposes. We do not sell your data to third parties
7. Data security
7.1.
The application and its database is being developed in a secure environment, using state of the art technical means and proven technologies and infrastructures. The implementation and continuous maintenance of several organizational, technical and security measures ensure that your data are kept safe and are protected from any risk of unauthorized access, unlawful or accidental disclosure, destruction, loss, alteration, or misuse.
7.2.
The access to, and the processing of, the data that the application collects are restricted to a specified number of persons to whom such access is absolutely necessary. Anyone who is authorized to access your personal data are bound by a contractual obligation of confidentiality.
8. Your rights
8.1.
Regarding your personal data you have the right:
- Of access: You can request and receive a copy of your personal data that we store and process, along with information on how we use them.
- Of rectification: You may request the correction of your personal data if they are wrong or incomplete.
- Of erasure: You may request the deletion of your personal data, if there is no specific reason or legal obligation for us to continue retaining and processing them.
- Of restriction of processing: You may request the restriction of processing of your personal data if you do not consent to the processing, or if they are not accurate and complete.
- Of data portability: You may request to receive your personal data in a structured, commonly used and machine-readable format, and request the transmission of those data to another controller.
- To object the processing: You may object to the processing of your personal data for particular reasons, and if your objections are justified we will stop processing them.
- To not be subject to automated decision-making: In accordance with Article 22 of the GDPR, you have the right not to be subject to a decision based solely on automated processing, such as profiling. However, this right does not apply if the decision (1) is necessary for entering into or the performance of a contract with us; (2) is based on your explicit consent; or (3) is authorized by law. As long as your CheckMeIn account is open and you use our application in compliance with our terms and policies, no automated processing or profiling is taking place, and consequently no automated decisions.
- To withdraw consent: In the cases that the processing of your personal data is based on your consent (such as the use of geolocation data and your voluntary sharing of a profile picture or other data) you may withdraw your consent at any time.
- To lodge a complaint to the Supervisory Authority: Should you be of the opinion that your rights have been infringed, you may lodge a complaint to the supervisory authority of your location. The Hellenic Data Protection Authority is competent for all complaints lodged in Greece (www.dpa.gr)
8.2.
To exercise any of the above rights, or for any question or request concerning the processing of your personal data, please send us an e-mail at damianos@checkmein-app.com with your full name, and specify what you want. We will respond to you as soon as possible. We may ask you to verify your identity, your account, or provide us with additional information in order to be sure that the request comes indeed from you and to be able to assist you.
8.3.
Exercising your rights is free of charge, unless the requests are manifestly unfounded or excessive. If so, we have the right to refuse to respond to your request, or we may charge a reasonable administrative fee.
9. Minors
If you are not yet eighteen (18) years old, you will need the consent of your parent or guardian in order to use the CheckMeIn application. This consent must be explicitly and freely given. By using the application you (or your parent/guardian on your behalf) declare that this consent has been provided and is valid.
10. Changes to this Privacy Notice
10.1.
This Privacy Notice may be updated. Whenever we make changes we will inform you, either via an announcement in the application itself, or via e-mail, or by other available means. We will also inform you about the date that the updated Privacy Notice enters in force.
10.2.
Once informed you have fifteen (15) days to object to the changes. If you do not react within this time period, we will consider that you agree and consent to the updated Privacy Notice, which will govern from then on.
10.3.
If you disagree with the updated Privacy Notice and object to its terms, we will not be able to continue offering you our services, since we can only process your personal data in accordance with applicable law and as described in this Notice. This Privacy Notice was last updated on 02/07/2024.
